This Privacy Statement and our Terms & Conditions collectively constitute the sole and entire legal agreement between you and FDVC. Your use of this Web Site is expressly conditioned on your acceptance of these Terms & Conditions and this Privacy Statement.
FDVC is committed to protecting your privacy, and this Privacy Statement explains how we collect, use, disclose, and safeguard your information when you visit or make a purchase on the Web Site.
FDVC understands the importance you place on the privacy and security of information that personally identifies you or your account information, and considers the responsible use of personal information to be an essential element in respecting the privacy of FDVC customers and the Web Site visitors. FDVC refers to and treats this information as to "Personal Information", and this Privacy Statement (the "Privacy Statement") describes FDVC practices with respect to your Personal Information.
1. Data collection.
You can visit the Web Site without telling FDVC who you are and without revealing any Personal Information about yourself. There are times, however, when FDVC may need information from you, including but not limited to your first and last names, and home and e-mail addresses. FDVC explicitly asks when it needs information that personally identifies you. An example of when FDVC may need such information is if you choose to create an account or to place an order.
FDVC does not collect Personal Information from those identifying themselves as less than 18 years of age.
FDVC collects the following categories of information, which may constitute “Personal Information” under applicable law.
1.1 Information you provide directly to FDVC:
(a) Identifiers such as your first and last name, email address, postal address, date of birth and telephone number; (b) Account credentials, including username and password; (c) Billing and shipping information necessary to process orders; (d) Order details, transaction information, and purchase history; (e) Information contained in customer inquiries or communications.
1.2 Information collected automatically:
(a) Device identifiers, IP address, browser type, and operating system; (b) Approximate geolocation information based on your IP address; (c) Web Site interaction data, including pages visited, time spent, and referring URLs; (d) Data collected through cookies, pixels, tags, scripts, and similar tracking technologies.
This information is collected for security, analytics, performance, and functionality purposes.
1.3 Cookies and tracking technologies
FDVC utilizes cookies and other technologies to (a) authenticate users and maintain session states; (b) preserve shopping cart and site preferences; (c) facilitate analytics and site performance; (d) support fraud detection and security functions.
Users may manage cookie settings through their browser; however, disabling cookies may impair access to certain features.
B. Data use.
When FDVC receives information about your session or about you, we may use it to process, fulfill and deliver orders, to facilitate customer service, to maintain, monitor and improve the performance, functionality, and security of the Web Site, to calculate and apply shipping options and discounted shipping rates tied to cart value, to conduct analytics, to improve product offerings, to customize user experiences, to support internal reporting, to display advertisements that are likely to be of interest to you, and for demographic statistics.
FDVC does not sell your Personal Information. Furthermore, FDVC keeps all your Personal Information private and does not share it with, or disclose it to any third parties unless acting under a good faith belief that such action is necessary to: (1) conform to legal requirements or comply with legal process, (2) protect and defend the rights or property of FDVC, (3) enforce FDVC Terms & Conditions, or (4) act to protect the interests of FDVC customers, visitors or others, or (5) necessary in connection with a merger, acquisition, corporate sale, or similar business transfer.
However, FDVC may need to provide your name and delivery address to third parties that FDVC uses for the purpose of delivering specific services to you, such as, but not limited to, payment processors, shipping carriers, analytics partners, data hosting providers, email and marketing service providers. These service providers are contractually bound to use personal information solely to perform services on FDVC behalf.
As part of FDVC services, FDVC may send to you periodic emails, not exceeding one per week as an average, containing information about FDVC, updates on new service features, service usage tips, information about third party services that are likely to be of interest to you, or notification of special offers FDVC thinks you will find valuable. If you do not want FDVC to contact you, you can choose to "unsubscribe", and FDVC will respectfully and promptly process your request.
C. Security.
When you choose to give FDVC personal and sensitive information over the Internet, FDVC protects such information both online and off-line. The Web Site offers the use of its own secure server, and industry-standard software to safeguard the confidentiality of your transmissions, such as firewalls and SSL (Secure Sockets Layer) encryption technology.
The Web Site secure server is kept locked in a secure data center, and the Web Site secure server software encrypts all information you input before it is sent to FDVC. These are the same technologies that reputable web sites use to safeguard credit cards and other personal information. Nonetheless, no security system is infallible, and we cannot guarantee absolute security of user data.
D. "E-mail to a friend" service.
If you elect to use our "E-mail to a Friend" service, FDVC will automatically send your friend a one-time email inviting him or her to visit the Web Site. FDVC stores your friend's first and last names, and email address for the sole purpose of sending this one-time email.
E. Cookies.
The use of cookies is a standard in the e-commerce industry. A cookie is a small file that may be placed on your hard disk for record-keeping purposes. Cookies help FDVC remember who you are but do not contain personally identifiable information. Cookies also help FDVC to enhance your experience of the Web Site, and to provide advertising that is targeted to your interests. You must have cookies enabled in your browser's security settings to use the shipping cart function of the Web Site.
F. Third party web sites.
FDVC Privacy Statement only addresses the use and disclosure of information the Web Site collects from you. To the extent that you disclose your information to other parties, different rules may apply to their use or disclosure of the Personal Information you disclose to them. The Web Site may provide links to third party advertisers that have their own privacy policies. Since FDVC does not control the web sites and the privacy statement of third parties, FDVC encourages you to review the privacy statements of these third party sites before you disclose your Personal Information to them.
G. Amendments.
FDVC may, from time to time, with or without notice to you, and in FDVC sole discretion, amend this Privacy Statement. FDVC will always post the current Privacy Statement on the Web Site so that you are always aware of what information FDVC collects, how FDVC uses it, and under what circumstances FDVC may disclose it.
H. Complaints.
If at any time you believe that FDVC has not adhered to the above principles, please notify us by e-mail at privacy@levillage.com, and FDVC will use all commercially reasonable efforts to promptly determine and correct the problem. I. "Wyoming specific privacy disclosures.
FDVC is governed under the laws of the State of Wyoming that does not currently impose additional statutory consumer privacy rights comparable to other state privacy regimes. However, FDVC voluntarily adheres to transparency and accountability standards consistent with prevailing U.S. privacy practices.
J. California consumer privacy act (CCPA) and California privacy rights act (CPRA).
The following disclosures apply solely to California residents, in accordance with the California Consumer Privacy Act of 2018 (“CCPA”) and the California Privacy Rights Act of 2020 (“CPRA”).
FDVC acknowledges to have collected in the preceding 12 months Personal Information such as identifiers (e.g., name, postal address, e-mail address), Commercial information (e.g., order history), Internet or network activity (e.g., browsing data, cookies), and Customer communications (e.g., inquiries, support messages).
FDVC does not sell or “share” personal information as defined under the CCPA/CPRA.
FDVC acknowledges that California residents have the following rights: (1) The right to know. The right to know is referred as to the right to request disclosure of (a) categories and specific pieces of personal information collected, (b) categories of sources, (c) purposes for collection, and (d) categories of third parties with whom information is shared, (2) The right to delete. The right to delete is referred as to the right to request that FDVC delete personal information, subject to statutory exceptions (e.g., legal compliance, transaction completion), (3) The right to correct. The right to correct is referred as to the right to request correction of inaccurate personal information, (4) The right to opt out. Since FDVC does not sell or share personal information, subject to statutory exceptions, FDVC is not required to provide an opt-out feature. However, FDVC voluntarily adheres to transparency and accountability standards consistent with prevailing U.S. privacy practices and provide an opt-out feature, (5) The right to Non-Discrimination. FDVC will not discriminate against any consumer for exercising their CCPA/CPRA rights.
